The website meliaceramics.com operates in accordance with the Consumer Protection Act (ZVPot), the Personal Data Protection Act (ZVOP-1), the Act on the Protection of Consumers Against Unfair Business Practices (ZVPNPP), and the Electronic Commerce Act (ZEPT).

The terms and conditions govern the operation of the website and regulate the business relationship between the seller and the buyer. They outline the ordering process, purchasing/payment, delivery, and return options. The buyer is bound by the terms and conditions that are valid at the time the order is placed.

Upon placing an order, the buyer is obliged to familiarize themselves with the terms and conditions, and by placing the order, confirms their awareness of them.


ACCEPTANCE OF TERMS
By using the website meliaceramics.com (hereinafter referred to as "the Website") operated by Melia Ceramics, Larisa Kreis s.p., you agree to these terms and conditions. These terms are binding for all users and visitors of our website. If you do not agree to all the terms, please do not use our website.

Melia Ceramics, Larisa Kreis s.p. reserves the right to change, amend, or update these terms and conditions at any time without prior notice. Changes will be posted on this website, and by continuing to use the site after changes are posted, you confirm your acceptance of the amended terms. Please regularly check this page to stay informed of any changes.

Any change to the terms and conditions will take effect on the day of its publication on the website. Your continued use of the website after changes are published means that you accept and agree to these changes.


PURCHASING PROCESS
Each product in the meliaceramics.com online store has its own name, description, dimensions, and price. By clicking the "ADD TO CART" button, the selected quantity of products is added to your shopping cart. The buyer can manage the cart's contents by adding, removing, or changing the quantity of ordered products. To proceed to the next step, click on "CHECKOUT" or "VIEW CART" to review the products before continuing with "PROCEED TO CHECKOUT." This is followed by entering your details and selecting a payment method, which includes the use of Stripe, allowing credit card payments. By clicking "BUY NOW," you complete your purchase.

Upon receiving confirmation of the order, we will begin processing and confirming it. Melia Ceramics, Larisa Kreis s.p. reserves the right to cancel or modify the order in case of issues with order processing, lack of stock, or other unforeseen circumstances. In such cases, we will notify the user and, where possible, offer an alternative solution.


ORDER CHANGES
If you wish to change or cancel your order, you must notify us within 1 hour of placing the order. If the buyer does not cancel the order, it will proceed to further processing. For any changes or cancellations, please contact us at hello@meliaceramics.com.


ORDER ACCEPTED AND CONFIRMED
Once the seller receives payment for the ordered products, they will prepare them for shipment and send them to the buyer. An original invoice will be included with all purchased products.

When the order is dispatched, the buyer will receive a completion notice via email. At the time of placing the order, a contract is concluded between the seller and the buyer, which is permanently stored with the seller. The seller may contact the buyer at their provided phone number or send an email to verify details or ensure accurate delivery.


SALE AGREEMENT
The buyer pays the amount to Melia Ceramics, Larisa Kreis s.p., and receives an invoice along with the goods or services. The package also includes a printed invoice. The seller issues a written invoice to the user who purchases a product from the online store, detailing the costs and explaining the right to withdraw from the purchase by returning the purchased product, if necessary and possible. The sales contract in the form of a purchase order is stored electronically on the seller's server.


PRICES
All prices are quoted in euros, and according to the first paragraph of Article 94 of the ZDDV-1, VAT is not charged (we are not a VAT payer). The applicable price is the one listed at the time the order is placed. Prices, as well as the terms of business, may change at any time without prior notice; however, changes do not apply retroactively. The price does not include delivery.


PAYMENT METHODS
The online store meliaceramics.com offers payment by debit or credit card (BA, Diners Club, Eurocard/Mastercard, Visa, Karanta, American Express).


INVOICE ISSUANCE
The seller issues an invoice immediately upon confirming the order and sends it along with the product to the buyer's address.


SUBSTANTIAL DEFECTS
The consumer can exercise their rights regarding substantial defects if they notify the seller of the defect within two months from the day the defect was discovered. The consumer must provide a detailed description of the defect in the notification and allow the seller to inspect the item. The consumer may notify the seller of the defect in person, for which the seller must issue a confirmation, or send it to the store where the item was purchased, or to the seller's representative with whom the contract was concluded (Article 37.a of the ZVPot). The consumer can request, at their discretion, the following due to substantial defects: rectification of the defect in the goods or a refund of the paid amount proportional to the defect, or replacement of the goods with new, flawless goods, or a refund of the paid amount.

The seller is not liable for substantial defects in the goods that appear more than two years after the item was delivered. If the subject of the contract between the seller and the consumer is a used item, the seller is not liable for substantial defects that appear more than one year after the item was delivered. It is considered that a defect existed at the time of delivery if it appears within six months of delivery (Article 37.b of the ZVPot).


When is a defect substantial?

  • When the item lacks the properties necessary for its normal use.
  • When the item lacks the properties necessary for a specific use for which it was purchased, and the seller was aware or should have been aware of this.
  • When the item lacks the properties that were explicitly or implicitly agreed upon or prescribed.
  • When the seller delivered an item that does not match the sample or model, unless the sample or model was shown solely for informational purposes.

LIABILITY
Although the seller strives to provide accurate photographs of the products available in the online store, all images should be taken as symbolic. Photographs do not guarantee the product's properties.


COMPLAINTS AND DISPUTES
In case of issues, the buyer should contact the seller via email at hello@meliaceramics.com to file a complaint. The complaint handling process is confidential. We strive to resolve any disputes amicably and peacefully.


OUT-OF-COURT DISPUTE RESOLUTION
In accordance with legal regulations, we do not recognize any out-of-court consumer dispute resolution provider as competent for resolving a consumer dispute that the consumer could initiate under the Out-of-Court Consumer Dispute Resolution Act.
